Why Arkansas same-sex parents won't be listed on a child's birth certificate

Arkansas same-sex parents will not be listed on their children’s birth certificates, the state’s highest court ruled on Thursday. The decision has raised questions about equal protection, and the state may still change its approach.

The ruling by a four-member majority of the Arkansas Supreme Court determined that only biological parents can be listed on a child’s birth certificate. It overturns last year’s decision by a lower court that married same-sex couples could automatically have both spouses listed as parents. 

For the state Supreme Court, it’s simply a question of biology. At the same time, marriage allows different-sex couples to be listed as parents, and the US Supreme Court’s ruling on gay marriage may mean that now applies to same-sex couples too. And the debate is complicated by state laws that require parentage to be tracked.

“It is clear that including both married spouses’ names â€" regardless of whether they are same-sex or opposite sex â€" on a child’s birth certificate is exactly the kind of benefit of marriage that the U.S. Supreme Court ruled should be extended to same-sex couples,” Kate Oakley, senior legislative counsel for the Human Rights Campaign, said in a press release.

That was the approach taken by Little Rock Circuit Judge Tim Fox in December 2015. Three same-sex couples brought a case arguing that the legalization of same-sex marriage gave same-sex parents the same rights to be identified as parents on their children’s birth certificates that different-sex parents already enjoyed. 

For parents, being named on a child’s birth certificate is important for all kinds of reasons, as LGBT news source The Advocate described. Without this legitimization, parents may struggle to put children on their health insurance or even pick them up from school.

When they won their suit, the three couples were granted the right to list the names of both partners on the birth certificates. But the state appealed the decision on the grounds that it was causing legal and logistical problems. Several days after the initial ruling, the Arkansas Supreme Court stayed the decision, preventing it from being extended to other couples.

One possible reason for the issues: birth certificates are woven into legislation and Health Board protocol in the state of Arkansas. Identifying biological parents is an “important governmental objective,” wrote Arkansas Supreme Court Associate Justice Josephine Linker Hart in the majority opinion, explaining that knowing who parents are allows the state to track public health trends and give children genetic information that they might need for medical reasons later on.

But different-sex Arkansas parents aren’t required to prove that they are the biological parents of the child, perhaps limiting the value of state tracking â€" and raising questions about unequal treatment of same-sex parents.

"There's no requirement that DNA be given or that there be a biological relationship to a child to get on a birth certificate for a father, for the non-birth parent," said Cheryl Maples, who sued on behalf of the three couples, the Associated Press reported.

“The inclusion of a parent's name on a child's birth certificate is a benefit associated with and flowing from marriage," wrote Arkansas Associate Justice Paul Danielson in the dissenting opinion.

The decision may have provided an impetus for the state to make some changes to the law.

“It is time to heed the call” to make changes heralded by decisions like Obergefell v. Hodges, which established the right to same-sex marriage, said Arkansas Chief Justice Howard Brill, according to NBC.

And though some state officials pronounced the state “gratified” that the court had chosen to uphold state law, they suggested that lawmakers might be willing to consider changes. Arkansas has so far been reluctant to amend its laws.

“If any changes are appropriate, it is the job of legislators to do so, not the circuit court,” said Judd Deere, a spokesman for Arkansas Attorney General Leslie Rutledge, AP reported.

As it stands, the ruling would require same-sex parents to obtain a court order if they want both spouses to be listed on a child’s birth certificate. Ms. Maples told AP that she has not yet decided whether to appeal to the US Supreme Court.

Florida couple 'are caught in the act of having sex in front of passersby on a sidewalk'

An amorous Florida couple have been charged with indecent exposure after police say they were caught having sex in public.

The incident that landed the libidinous pair, identified as 26-year-old Ashley Wetzel and 50-year-old Henry Niblack, occurred just before 10:40pm Wednesday in the area of 3 Avenue North and Mirror Lake Drive North, not far from a St Petersburg park.

According to an arrest report, Niblack and Wetzel were seen having a sexual intercourse in front of people passing by on the sidewalk.

The report, first obtained by The Smoking Gun, offers graphic details of the encounter, describing how Niblack was allegedly observed 'throwing his hips back and forth, inserting his penis into Wetzel's vagina.'

The responding officer noted in his report that both Niblack and his partner had their pants around their ankles.

The pair were arrested at the scene and each was charged with a misdemeanor count of exposure of sexual organs.

Niblack, a construction worker from St Petersburg, was released from jail Thursday after posting $150 bond, while Wetzel remained in custody on $650 bond.

Both suspects have criminal records: Wetzel has a pending case against have stemming from theft charges and a past conviction on a charge of trespassing, while Niblack's rap sheet includes charges of domestic violence, possession of marijuana and violation of injunction.

Jenna Dewan Tatum Dishes on 'Primal, Earthy' Sex Life With Channing Tatum

It’s primal, earthy, sexual energy by nature. You feel your body in a certain way. Channing is very much the same way. He’s very in tune with that."

Back in June, the Magic Mike actor joked about their time behind closed doors during a Facebook Live interview with Cosmopolitan. "I just lay there. I just lay down; sometimes I nap. Yeah, she’s really athletic. We get down!" he said at the time. "We truly have all different kinds of sex. Sometimes it's like, 'Look, you gotta get this done. I gotta go to work.' And that's a real thing. To me, that's us being completely open. … Then you have full-on, just completely totally connected otherworldly connections."

The couple, both 36, met while starring together in 2006's >Step Up. They initially decided to not jump into a romance but changed their minds when he got inebriated one night.

What does it mean to love someone unconditionally? Is it better to be loved unconditionally?

Q. If a person is loved regardless of their actions, beliefs, attributes, and conditions, can that love not simply have gone to someone different? Is it not a greater honor to be loved for who you are? Is it better to have your love at risk than to love, unconditionally, recklessly, and randomly?

A. I love my boyfriend unconditionally. That means: I love him for who he is and the decisions he makes, the things he does, how he grows and who he becomes. It doesn't mean I can love anyone. It means I love him and respect his views, his attributes and personality. Unconditionally means I wont walk out on him for dumb reasons. It means I'll listen to what he says and if we have problems I'll try to work it out. It means I won't hurt him or hurt his feelings. It means i won't leave him for any dumb reason. It means I dont want to leave him. It means I can tell him anything and listen to anything he says. It means he's the love of my life, my soulmate and I'll stick with him no matter what. It means he's an amazing little dude and I know him well enough to know I dont want to love anyone else but him :)

Q. Some people can pick and choose who they love; they seek a balance or a rewarding experience for both paties.
Some people appear to express agape; they try to love everybody in some way, though that's often impossible.
Some people are narcissistic; they cannot love anyone as much as they love themselves.

In what way(s) has your love for others (or lack of it) given you a sense of self-worth?

A. My love for others has helped me get through life. I can't hate people for some reason. I just wasn't made to hate them I guess. It helps me get through life letting people know I love them and care. I don't think it is impossible to love everyone in some way. I'm pretty sure I can love everyone in some way.

My dad which has never been there for him I love him more than ever, because I found out that my mother kept me away from him which I love her as well, because she raised me right. She has taken my daughter from me, but I still love her. Okay if you knew every person in my life you could ask me why I love every one of them.

A. One of the biggest things that loving others has taught me was a sense of selflessness. Just like when you love your job or an activity you put everything into and you go really hard the whole time. For me that same thing happens when I truly love someone. I am totally selfless and I put my all into a person so that I can have the best outcome possible. Having different experiences where I step outside of the usually selfish person that I am and I am able to give more than I usually do has allowed me to see how much I can do and all that I can attain if I am dedicated and devoted to something or someone.

In Taiwan's LGBTQ community, many oppose a special partnership law since it would apply only to gays rather than open up marriage for all, Liu said.

"Having more liberal LGBTQ rights will be a good way not only to benefit the LGBTQ population in Taiwan, but also to just let the world know that Taiwan is a country for social democracy and [has] a lot of the liberal values that progressives in the U.S. also hold," she said.

This is what having sex with Channing Tatum is like

If the bedroom’s rocking, don’t come knocking on Channing Tatum and Jenna Dewan Tatum‘s door.

Married for seven years, Channing and Jenna, both 36, met on the set of the 2006 dance flick “Step Up.” While their steamy chemistry brought the film to life, the couple’s real-life romance was heating up off screen.

But as Jenna recalled, Channing had an interesting way of making their relationship official.

“It was two nights of being weird. We hadn’t even kissed,” she explained. “And then he went out partying with a bunch of dancers. His room was right above mine, and he came down drunk with a sombrero on, banging on my door. He was like, ‘I couldn’t stop thinking about you. Let’s do this. After getting engaged in September 2008, Channing and Jenna tied the knot the following July. Four years later, they welcomed daughter Everly. Though Jenna’s adjusted to motherhood, as a Reiki enthusiast she uses the Japanese healing technique in her family’s daily life.

The crowd-pleaser: What is the most popular sex position?

AlterNetAlterNet> Defining sex is easy, but having it is slightly more complicated â€" namely, because there are a lot of different ways to get it on. But is there a crowd favorite out there?

According to Dr. Ed, there is. In a survey of 2,000 people in the United States and the United Kingdom, the team at Dr. Ed found that more people prefer doggy style to any other position. According to their experts, doggy style “allows for deeper penetration,” making the G-spot easier to reach. Perhaps that’s why over 35 percent of respondents tagged it as their go-to favorite. Missionary came in second, with cowgirl following close behind.

Other popular positions included holding legs up, spooning and reverse cowgirl. The 69 position also made it onto the list, a rather unsurprising finding. Research suggests oral sex is one of the most reliable means by which women can achieve orgasm.

But while both men and women agreed that doggy style was the most enjoyable way to have sex, they weren’t able to see eye-to-eye in all areas. Men ranked anal sex as the ninth most pleasurable position, while it didn’t even make it into the top 10 list for women. (Some research has shown that anal sex is becoming more popular among some women.)

Sexual orientation didn’t seem to influence the respondents’ preferences in any significant way. Straight, bisexual and gay participants all ranked doggy style as their favorite position.

Curiosity about certain sexual positions spanned the spectrum of sexual orientation. All respondents were equally curious about the tabletop position (in which one partner sits on the edge of a table while the other penetrates them while standing up). The 69 position while standing up was another popular pick on the wish list.

Apparently, most of the guys learned about these stunts online. Fifty-three percent of men surveyed said they picked up their sex moves from porn. Women, on the other hand, said they learned about their favorite sex positions from a real-life partner.

But maybe there’s something about watching all that online smut that makes one a little bit more adventurous. Over 75 percent of men said they were the ones to initiate a new position. Fifty-nine percent of women admitted that their partners were the ones wanting to mix it up.

But as they say, in life, there is no pleasure without pain. Nearly 38 percent of men said the thing that scared them most about sex was the possibility of hurting their partner â€" not exactly a huge surprise, given the number interested in anal sex. Less than 9 percent listed hurting themselves as a concern (they must have missed our article on broken penises). Women were more worried about not being able to sufficiently please their partner. Over 31 percent were worried about not being flexible enough in bed.

This is what having sex with Channing Tatum is like

If the bedroom’s rocking, don’t come knocking on Channing Tatum and Jenna Dewan Tatum‘s door.

“… I’ve always been a very sexual person. We definitely have a very happy and healthy [sex life],” the actress spilled in the January issue of Cosmopolitan.

“Something about being a dancer connects you to your physical body. It’s primal, earthy, sexual energy by nature. You feel your body in a certain way. Channing is very much the same way.”

Married for seven years, Channing and Jenna, both 36, met on the set of the 2006 dance flick “Step Up.” While their steamy chemistry brought the film to life, the couple’s real-life romance was heating up off screen.

But as Jenna recalled, Channing had an interesting way of making their relationship official.

“It was two nights of being weird. We hadn’t even kissed,” she explained. “And then he went out partying with a bunch of dancers. His room was right above mine, and he came down drunk with a sombrero on, banging on my door. He was like, ‘I couldn’t stop thinking about you. Let’s do this. I just want to be with you.’ From that point forward, we were together.”

After getting engaged in September 2008, Channing and Jenna tied the knot the following July. Four years later, they welcomed daughter Everly. Though Jenna’s adjusted to motherhood, as a Reiki enthusiast she uses the Japanese healing technique in her family’s daily life.

“I like to play around. I’ll do it with Evie when she’s getting overwhelmed,” Jenna shared. “It’s an ancient healing modality from Japan where you tap into your conscious energy conflict. Chan loves it. He gets all the nice side effects of having a hippie wife.”
